(c) With respect to all workers who are immediately or directly employed for the purposes of the Contractor`s part of this Contract, the Contractor shall comply with or enforce compliance. The contract of the Ministry of Public Works labour regulations that may be published by the Government from time to time with respect to the payment of wages, deductions of wages from time of pay, the recovery of unpaid wages and unauthorized deductions, the keeping of the wage register, the publication of tables of wages or wages and other conditions of employment, periodic inspections and reporting in all other matters of a similar nature. (d) Original work/special repairs/renewal work – 6 months after completion, with the exception of works such as construction work, bridge work, cross-drainage work, etc., where the deposit is refunded 6 months after the completion or expiration of a full rainy season, whichever is later, provided that the final invoice has been paid. (1) Performance-related financing amounts paid prior to payment for the delivery of an item are liquidated by deducting a percentage or a certain dollar amount from the delivery payment. If performance-related financing payments are made on the basis of a delivery item, the liquidation amount for each of those items is equal to the percentage of the price of that delivery item previously paid for performance-based financing payments or the specified dollar amount. If performance-related financing payments are made on a comprehensive contractual basis, liquidation shall take place either by predetermined liquidation amounts or by a liquidation percentage. (1) If any of the following occurs, the Government may, by written notice to the Contractor, withhold further withdrawals from the Special Account and other payments under this Agreement: (A) On the 30th day after the designated accounting officer receives a valid invoice from the Contractor (except as provided in paragraph (a)(1)(ii) of this clause). (1) Number of instalment payments for each item. Each separate price unit of each item is allowed to make a fixed number of monthly payments. The number of instalment payments authorised for each unit of an article shall be equal to the number of months between the date of award of the contract and the date preceding the first delivery of the first separate unit of the article. For example, if the first scheduled delivery of a separately calculated line unit occurs 9 months after the order, all units evaluated separately from that item with 8 installments are allowed.
e) Maximum payment. If the sum of all unprocessed advance payments, unpaid interest charges and other payments exceeds ____ per cent of the contract price, the Government will withhold the additional payments to the contractor. Upon conclusion or termination of the contract, the government will deduct from the amount due to the contractor all unpaid advance payments and any interest charges payable. If previous payments to the contractor exceed the amount due, the excess amount must be paid to the government upon request. For the purposes of this paragraph, the Contract Price shall be deemed to be the stated Contract Price of ____, less any subsequent price reduction under the Agreement, plus (1) any price increase resulting from the terms of this Agreement for price conversion or escalation, and (2) any other price increase not exceeding $___in total [insert an amount not exceeding 10 per cent of the specified Contract Amount inserted herein]. paragraph]. All payments withheld under this paragraph shall be used to reduce unprocessed advances. When the complete liquidation has taken place, the contract payments will be resumed. (2) The date of the first written request for payment, including any claim for payment resulting from late termination.
(1) Reluctance towards subcontractors. If, after payment to a first-stage subcontractor, a contractor receives written notice under 40 U.S.C. 3133 from a supplier or subcontractor of the first-stage subcontractor (hereinafter referred to as the « second-stage subcontractor ») alleging a defect in the performance of such first-stage subcontractor under the contract, for which the contractor may be ultimately liable, and if the Contractor determines that all or part of the future payments that are otherwise due at that first level, the Subcontractor is subject to withholding in accordance with the Subcontract agreement, the Contractor may, without any obligation to pay an interest penalty in accordance with paragraph (e) (6) of this clause, (4) interest penalty. The designated paying agent shall automatically pay an interest penalty without the contractor`s request if payment is not made by the due date and if the conditions set out in subparagraphs (a)(4)(i) to (a)(4)(iii) of this clause are met, if any. However, if the due date falls on a Saturday, Sunday or public holiday, the designated paying agent may make the payment on the next working day without incurring a penalty payment for late payment. (A) seven days after the correction of the performance deficit found in the subcontracting (unless the funds for that purpose are to be recovered from the Government due to a reduction in paragraph (e) point (5)(i)) of this clause; or (i) the due dates on the contractor`s invoices for meat, meat, food or fish; perishable agricultural products; and dairy products, edible fats or oils as well as foods produced from edible fats or oils – (4) The Contractor may collect any waste resulting from production under this Contract without the Customer`s consent, but the Product will be deducted from the service costs. (1) Except as provided in subsection (a)(2) of this clause, the Contractor agrees to accept payments due under this Agreement by a third party in lieu of payments directly from the Government in accordance with the terms of this clause. The third party and, if applicable, the government commercial acquisition card to be used are specified elsewhere in this Agreement. (b) liquidation. Except as provided in the « Termination for the Convenience of Government » clause, all progress payments will be liquidated by deducting from any payment under this Agreement, except advance payments or progress payments, unrecuted advance payments, or 80% of the amount invoiced, whichever is less. The Contractor shall reimburse the Government for all amounts required by a retroactive price reduction after calculating the liquidations and payments on previous invoices at discounted prices and adjusting the unpaid progressive payments accordingly.
The Government reserves the right to unilaterally switch from the ordinary liquidation rate to another interest rate if it deems it appropriate for appropriate contractual financing.
